Judy Waltz, partner and chair of the firm’s Health Care Practice Group, is speaking in BARBRI’s upcoming webinar titled “Healthcare Regulation After Loper Bright and Corner Post: Maintaining Compliance in a Post-Chevron World” on February 25.
The webinar will discuss the two notable U.S. Supreme Court decisions that were anticipated to have a significant impact on health care regulation — Loper Bright Enterprises v. Raimondo, which overturned the Chevron doctrine, and Corner Post v. Board of Governors of the Federal Reserve System, which expanded the time period during which plaintiffs may challenge agency rules, allowing rule challenges even years after implementation.
In an industry highly regulated by federal agencies such as U.S. Health and Human Services (HHS), Food and Drug Administration (FDA), and Centers for Medicare and Medicaid Services (CMS), counsel should understand how these decisions have affected health care regulation and judicial interpretation since they were overturned, which health care rules are or may be susceptible to being challenged, and how to help their clients remain compliant in a post-Chevron world.
