If Defense Secretary Mark Esper were to cancel the contract, Amazon or Microsoft could lodge a protest with the Government Accountability Office or file a lawsuit arguing that the cancellation was arbitrary and capricious and tainted by political interference, Murray said. But such arguments are “tough to show” in court, he added, especially if the Pentagon can establish a written record supporting the decision.
