Texas Lawyer featured comments from Gardere Partner Peter Scaff regarding Houston’s First Court of Appeals decision to dismiss a tortious interference case against TGS-NOPEC Geophysical Co. over a breach of an alleged production sharing contract with the government of the Republic of Togo.
Brenham Oil & Gas Inc. argued that since it is a Kemah, Texas-based company and TGS has a principal place of business in Houston, the suit was properly instituted in Harris County, Texas.
"The importance to our clients is that, notwithstanding the contacts with the state of Texas, if Brenham alleged that TGS changed the minds of the government officials of Togo, all of those minds are in Togo,” said Mr. Scaff. “Therefore Judge Bill Burke wisely exercised his discretion in dismissing the case.”
