Ganoza noted the potential of NFTs to engage with young consumers makes them a ripe place for brand infringement, and cited the recent lawsuits involving Nike and Hermès as examples.
Risk and opportunity blur where NFTs are concerned, Ganoza explained, adding that, “In-house counsel have to understand this is another platform where they have to enforce and be vigilant over the use of their trademarks.”
