Nan Beaird is an experienced government affairs regulatory attorney who assists local, national and international clients with their regulatory needs. Her practice centers on the vector between the regulatory and business worlds. She frequently assists clients who need representation in the areas of insurance, insurance taxation, the prescription drug business, traditional and innovative healthcare businesses, and payment issues such as government payment audits and payment delays.

Through her years as a regulatory attorney, Nan has developed significant and positive relationships with the Texas Department of Insurance during the tenures of multiple Commissioners of Insurance, and she has represented both insurers (including captives) and those who have created entities and arrangements that raise questions about whether the “business of insurance” is involved. Nan also represents clients with significant issues before the Division of Workers’ Compensation. Important to her focus on insurance is a corresponding representation of clients with insurance tax issues before the Texas Comptroller of Public Accounts.

In the healthcare arena, Nan represents national drugstore chains, specialty pharmacies, and pharmacy benefit managers, pharmacists, nurses and home healthcare companies. She advises businesses that must comply with federal Stark Law, state and federal Anti-Kickback Statutes and related laws, and she provides assistance her clients in investigations.

Because the payment disputes that arise between providers and government payors can be of great significance to the viability and profitability of those providers, Nan represents her clients in payment audits before the Texas Health and Human Services Commission – Office of Inspector General, and the Centers for Medicare and Medicaid Services.

Nan can advise clients on both the uses of and responses to inquiries under the Texas Public Information Act.
