The courts recently refined eDiscovery rules set nine years ago in the Federal Rules of Civil Procedure. Since the Texas Rule of Civil Procedure 196.4 was interpreted by the Texas Supreme Court in the context of the 2006 federal rules, lawyers must understand how eDiscovery practices will be impacted. Cooperative techniques with eDiscovery e-Neutrals in eMediation and special masters will be discussed.
