Kyle Faget Assesses Latest Federal Health Care Funding Actions
Foley & Lardner LLP partner Kyle Faget assessed the U.S. Department of Health and Human Service’s latest federal health care funding actions in Inside Health Policy.
Faget said while the federal government cannot tell clinicians how to practice, it is within the government’s scope to dictate the care it chooses to fund.
On the challenge from the HHS’ Office of Civil Rights over Illinois’ health care right of conscience law, which requires providers to ensure patients receive proper information or referrals from medical professional who do not want to provide a particular treatment based on personal beliefs, Faget noted that patients are generally not especially well-versed in health care options and resources.
“It may be that that person walks out and thinks ‘this is not care that is available to me,” she added. “They may or may not ultimately take that next step for themselves.”
