Partner Don Schroeder was quoted in a Law360 article, “Labor And Employment Legislation, Regs To Watch In 2018” about the National Labor Relations Board Election Rule.
The NLRB is expected to roll back a number of decisions the business community has criticized as overly labor-friendly, including its so-called quickie election rule which shortens the length of time between workers filing a union petition and the board conducting an election.
The NLRB’s Republican majority voted last month to issue a request for information asking stakeholders if the rule should be kept in place, adjusted or rescinded entirely. Given the management community’s hostility to the rule, that last option is the most likely, Schroeder said.
“I would not be shocked by a full rollback, just like I would not be shocked by a continuing effort to dismantle some of the pro-labor decisions that came out of the Obama board,” he said.
