False economy: Don't misclassify employees as independent contractors

Foley Senior Counsels Jennifer Neumann and Scott Callen authored an article that appeared in Computerworld on October 25, 2010 titled “False economy: Don’t misclassify employees as independent contractors.” The authors discuss the potential IRS legal penalties and fees that can result from employers misclassifying a computer professional as an independent contractor. They note that federal and state government agencies are aggressively on the lookout for such misclassifications and recommend that employers have company policies, practices and agreements regarding classifications reviewed for legal compliance in order to avoid stiff penalties.
