WHO CAN PARTICIPATE: The Holiday Greeting Card Art Contest (the “Contest”) is open to Boys & Girls Clubs children in Grades K-8.

HOW TO ENTER: Artwork must be submitted to your local Boys & Girls Club contact no later than October 14, 2022. Artwork must be submitted along with a completed and signed Parental Consent Form.

Artwork Requirements: For this Contest, students are asked to create an original piece of art that embodies the following theme: “What Makes the Holidays Magical?” Submitted artwork must:

• be the club member’s original creation (i.e., may not include copyrighted, trademarked, patented, or previously published material);
• be portrait orientation on 8.5”x11” paper (no 3D please);
• be non-denominational in nature; and
• contain only images (no text).

Artwork which, in Sponsor’s or judges’ sole discretion, contains any type of vulgarity or objectionable content will be disqualified. Artwork that does not meet these stated criteria, or artwork that (in Sponsor’s or judges’ sole discretion) may technically meet the stated criteria but do not reflect the intent and the spirit of the Contest, is not eligible.

ARTWORK SELECTION: Artwork will be judged by a panel of judges selected by the Foley & Lardner LLP (the “Sponsor”), which may include attorneys and staff. Artwork will be judged based on the three criteria below:

• adherence to theme of “What Makes the Holidays Magical?” (30%)
• creativity/originality of art submission (40%)
• technique/craftsmanship/overall composition of art submission (30%)

The judges will evaluate artwork based on the weighted criteria noted above. In the event of a tie, the tied artwork that received the higher score in the “technique/craftsmanship/overall composition of art submission” category will be deemed the selected artist.

Selected artists will be notified on or about November 7, 2022 by their respective Boys & Girls Clubs manager or art teacher.

Sponsor intends to feature the selected designs in the Sponsor’s holiday greeting cards, which may be purchased or given away by Sponsor’s employees. At Sponsor’s discretion, the selected artists may have their first name, grade, and Boys & Girls Clubs location printed on the Sponsor’s holiday greeting cards.

PRIZES & APPROXIMATE RETAIL VALUES (ARV): Selected artists will receive:

• a framed copy of their artwork;
• a pack of 10 holiday greeting cards; and
• $250 Visa gift card.

All taxes, fees, and surcharges on prizes are the sole responsibility of the selected artists. Gift cards subject to terms and conditions. Prizes will be awarded to child’s parent or guardian on behalf of the child. If requested by Sponsor, affidavit of eligibility, prize acceptance form, publicity release, and/or mutually acceptable liability releases may be required where not prohibited.

LICENSE TO ENTRY MATERIAL: Sponsor intends to feature the selected artwork on its 2022 holiday greeting cards. Accordingly, as a condition of participation, parent of participating child grants Sponsor a perpetual, irrevocable, royalty-free, fully sub-licensable and transferable worldwide non-exclusive license and permission to use, reproduce, edit, modify and exhibit, create derivative works of, transmit, distribute, and display the artwork, in any and all media formats, whether now known or hereafter developed. Parents will have no right of approval, review, or modification as to the future use, modification, or display of child’s artwork, and shall have no right of compensation from, credit, or attribution, or approval over any use of artwork by Sponsor.

Sponsor has the right but not the obligation to post any artwork for worldwide viewing on the Internet. All artwork posted on Sponsor’s website or elsewhere may be available to be viewed by the general public.

Parents/guardian of participants agree to execute any additional written authorization or other papers requested by Sponsor in connection with the granting of such license, and any such written papers requested will be required as a condition of obtaining the prize, or another artist will be selected.

PUBLICITY RELEASE: By entering, entrants authorize the Sponsor to post their entries on the Sponsor’s and/or Boys & Girls Clubs’ webpage, social media pages, and/or printed magazines/catalogs for viewing by a world-wide audience. Except where prohibited, acceptance of a prize constitutes artists’ consent that his or her name, likeness, voice and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent. Submission of content to be posted online constitutes permission for same.

RELEASE: By entering, entrant agrees to accept and abide by the Official Rules of this Contest and agrees that any dispute with regard to the conduct of this Contest, rule interpretation, or award of prize shall be submitted to Sponsor, whose decision shall be binding and final. By participating, you release Sponsor, the Boys & Girls Clubs, and all of their employees and agents, from and against any and all injury, loss, or damage caused or claimed to be caused by your participation in the Contest.

ADDITIONAL RULES: Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Contest, or in the announcement of prizes, including erroneous appearance of qualification for a prize. Sponsor reserves the right, in its sole and absolute discretion, to modify, cancel, or suspend this Contest, or to amend the Official Rules at any time, without prior individual notice, should any factor interfere with the administration, security, or proper play of this Contest as contemplated by these Official Rules. If for any reason Sponsor is prevented from continuing with this Contest, or the integrity and/or feasibility of the Contest is severely undermined by any event, Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Contest without further obligation. If Sponsor in its discretion elects to so abbreviate the Contest, Sponsor reserves the right, but not the obligation, to award the prize from among all eligible entries received to date.

DISPUTES/CHOICE OF LAW: Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this CONTEST or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in WISCONSIN, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees, (3) no punitive, incidental, special, consequential or other damages, including, without limitation, lost profits, may be awarded (collectively, “Special Damages”), and (4) entrant hereby waives all rights to claim Special Damages and all rights to such damages multiplied or increased. WISCONSIN law, without reference to choice of law rules, governs the CONTEST and all aspects related thereto.

PRIVACY: Personally identifiable information submitted for this Contest will be used to administer the Contest, select artists, and fulfill prize. Such information may be shared with Sponsor’s agents and affiliates as necessary to administer the Contest, confirm artist identity or materials, and fulfill the prize. Information will be treated in accordance with Sponsor’s Privacy Policy available at https://www.foley.com/en/general/foley-lardner-llp-website-privacy-notice.

LIST OF SELECTED ARTISTS: To receive any legally-required names of selected artists, send a legal-size, self-addressed, stamped envelope within sixty (60) days of the end of the Contest to: Kristina Sasich, Foley & Lardner LLP, 777 East Wisconsin Avenue, Milwaukee, WI 53202.

QUIÉN PUEDE PARTICIPAR: El Concurso de Arte de Tarjetas de Felicitación de Festividades (el “Concurso”) está abierto a niños de Boys & Girls Clubs en los grados K-8.

CÓMO PARTICIPAR: Las obras de arte deben enviarse a su contacto local de Boys & Girls Club a más tardar el 14 de octubre de 2022. Las obras de arte deben enviarse junto con un Formulario de Consentimiento de los padres completado y firmado.

Requisitos de las obras de arte: para este concurso, se les pide a los estudiantes que creen una obra de arte original que incorpore el siguiente tema: "¿Qué hace que las fiestas sean mágicas?" Las obras de arte enviadas deben:

SELECCIÓN DE LA OBRA DE ARTE: La obra de arte será juzgada por un panel de jueces seleccionados por Foley & Lardner LLP (el "Patrocinador"), que puede incluir abogados y personal. Las obras de arte serán juzgadas en base a los tres criterios siguientes:
