U.S. District Judge Lucy Koh struck more than $450 million from damages awarded to Apple in last summer's verdict against Samsung. Gardere Partner Peter S. Vogel, chair of the Firm's Internet, eCommerce and Technology Industry Team discussed the decreased damages award with E-Commerce Times.
"On a number of the claims for the alleged damages, the jury appeared just to take 40 percent of whatever Apple's expert said," Mr. Vogel said. "I think the judge concluded the jury didn't do any independent evaluation. This is – I hate to say it, but – relatively common. That is because juries make determinations outside the foul lines of the law."
