Foley Partner Donald Schroeder was quoted in a Hotel Management article, “Identifying, mitigating joint-employer liability remains crucial for hotels,” discussing the importance of mitigating joint-employer liability for hotels.
Schroeder explained, as it relates to employers and employees determining who is in control within a joint-employment situation: “Now is a good time for both parties in a relationship to review their contracts in view of the [Browning-Ferris] decision as it is currently constituted.”
He also stated that is important for employers and employees to “ensure you are consistent in how you apply the contractual provisions to the extent that you can avoid blurring the line between the two entities.”
