Of Counsel Mark Neuberger was quoted in a Law360 article titled “COVID-19 Screenings Challenge Ideas of Paid Work Time,” which discusses whether COVID-19 screenings constitute compensable work time.
No two scenarios are alike when it comes to assessing a screening’s compensability because so many factors, such as the location and length of the screening, come into play, shared Neuberger. He went on to add that: “Even if COVID does go away soon, I think in the future these kinds of issues are going to come back up, so employers ought to invest the time now … and come up with some policies and procedures. So the next time we have a pandemic, you don’t have to start from scratch.”
