Foley Partner Russell Beck authored an article titled “Decision focusing on 93A significant for different reason” in the September 3, 2009 issue of Massachusetts Lawyers Weekly. Beck discusses the outcome of Synergistics Technology v. Putnam Investments and its effect on noncompete agreements. He notes that the Court’s reiteration of the impact of technology on the enforceability of a noncompete, particularly with reference to Internet commerce, may indicate a greater tolerance for noncompete agreements with a farther geographic reach than previously found reasonable.
