Gordon Davenport III

Gordon Davenport III is a partner and litigation attorney with Foley & Lardner LLP who has more than three decades of experience representing clients in high stakes complex commercial litigation. His work includes defense of consumer product class actions, business disputes, business torts and other complex commercial cases.

Mr. Davenport also has extensive experience in the insurance field, including coverage disputes, class actions, and issues involving D&O and other executive risk coverages. Mr. Davenport is a member of the firm’s Business Litigation & Dispute Resolution and Insurance & Reinsurance Litigation practices.

Admissions and Professional Memberships

Mr. Davenport is admitted to practice in Wisconsin, and in the U.S. Supreme Court, the U.S. Courts of Appeals for the Federal, Fifth, Seventh and Eleventh Circuits, and the U.S. District Courts for the Eastern and Western Districts of Wisconsin. He is a member of the Dane County Bar Association, State Bar of Wisconsin and American Bar Association (Litigation and Tort and Insurance Practice Sections).


Mr. Davenport is a graduate of the University of Wisconsin, where he received his business administration degree in 1980 and his J.D. degree (cum laude) in 1983. He was a member of the University of Wisconsin Law Review and was elected to the Order of the Coif.


Mr. Davenport has been Peer Review Rated as AV® Preeminent™, the highest performance rating in Martindale-Hubbell's peer review rating system. In 2011-2016, The Legal 500 recognized Mr. Davenport in the area of insurance: advice to insurers. He was selected for inclusion in the 2007, 2008, and 2011-2016 Wisconsin Super Lawyers® lists and has also been selected by his peers for inclusion in The Best Lawyers in America© since 2010 in the field of commercial litigation. Representative Matters

Successfully represented a national health insurer in a proposed class action alleging that the copayments charged by the insurer for chiropractic care violated state and federal law. The case was dismissed (on our motion) on ERISA grounds.
Assisted a national life and health insurer with the drafting of new agent and manager contract forms for its national captive sales force.
Foley represents a major life and health insurer in three lawsuits in Florida state court against former senior sales managers who, after leaving the company, violated their contracts by pirating agents and customers, and failing to repay amounts loaned to them by the company. The defendants are asserting counterclaims.
