Brooke Clarke helps provide strategic legal counsel to companies helping them navigate and resolve disputes effectively. Brooke has experience in researching legal issues related to labor and employment law, consumer class actions, and construction law. Brooke is a member of the Litigation Department and the Commercial Litigation Practice Group. Brooke began at Foley as a summer associate. She also worked at the Attorney General’s Office of Appeals, Writs, and Trials in San Diego as a legal fellow, and the San Diego County District Attorney’s Office as a legal intern.
Beyond Arbitration Agreements: A California Court Interprets Dueling Employment Agreements
In a September 2025 decision, a California appellate court looked beyond the terms of an employee’s arbitration agreement to determine whether said arbitration agreement was unconscionable (and thus unenforceable). In the case, Gurganus v. IGS Solutions LLC, the court ruled that an employee’s arbitration agreement was unconscionable when read in connection with the same employee’s confidentiality agreement.
