We will discuss what employers should be doing with their retirement and health plans as a result. - US Airways, Inc. v. McCutchen — Have You Reviewed Your Subrogation Provision Recently?
Every plan administrator should carefully review the specific language of the subrogation provision in its health plans in light of the Supreme Court’s most recent decision addressing the availability of equitable relief under Section 502(a)(3) of ERISA.
