In a surprising and so far unexplained move, CMS rescinded Change Request 5449 dated January 26, 2007. CMS, which only a month ago implemented new regulations on the same subject, received numerous questions and comments, and clearly appears to have taken them seriously.
Consequently, the interpretations found in the January 26th Change Request, detailed in Foley’s Health Law e-Alert from Friday, February 16, 2007, will not be implemented by CMS at this time. However, the new IDTF regulation (42 CFR 410.33(g)) that went into effect on January 1, 2007 remains in effect today.
