Board of Contributors: Knowledge of Language, Culture Key in Latin America FCPA Probes
Foley Partner Jaime Guerrero and Associate Rob Iseman authored an article that appeared in the Daily Business Review on July 27, 2011 titled “Board of Contributors: Knowledge of Language, Culture Key in Latin America FCPA Probes.” The authors discuss the increasing number of investigations of companies in Latin America for alleged violations of the Foreign Corrupt Practices Act (FCPA). They state that companies facing a FCPA inquiry should use attorneys fluent in the language of the country where the investigation will be conducted, adding that an attorney fluent in the local language can efficiently review key documents and analyze their importance. The authors note that an understanding of the socio-political culture in which a scrutinized company operates is also critical to assessing an FCPA investigation.
