Foley Partners Pamela Johnston and Lisa Noller and Associate Mary Conklin authored an article that appeared in the September 2011 issue of The Corporate Counselor titled “Responding to A Government Subpoena or RFI.” The authors review four brief case studies which illustrate the government’s reactions when it does not receive what it believes it is entitled to in response to a request for information (RFI) or subpoena. They state that responding to a broad government subpoena on behalf of a large company can potentially be difficult for in-house lawyers, adding that it can be beneficial to seek and obtain advice from outside counsel. The authors also note the importance of transparency with the government when choosing to disclose or withhold documents and information.
