Foley Partner Lawrence Vernaglia is quoted in an article titled “CMS Guidance Bars Rebilling Under RACs, But Alternate Route to Payment May Exist” in the January 19, 2009 issue of Report on Medicare Compliance. Vernaglia provides his insight into a CMS guideline that prevents hospitals from rebilling when Recovery Audit Contractors (RAC) deny inpatient claims for lack of medical necessity. Vernaglia notes that hospitals will be forced to appeal more RAC determinations, resulting in higher government and hospital costs.
