According to Gardere Partner Peter S. Vogel, chair of the Firm's Internet, eCommerce and Technology Industry Team, "Unjust enrichment is a tort, which says that a defendant got money unfairly to the plaintiff's disadvantage. One of the advantages to a tort is that you can sue for punitive damages as well."
