In an article on the Genetic Information Non-Discrimination Act (GINA), Partner Scott Callen said GINA limits conversations in the hiring process by prohibiting medical and genetic questions that do not influence a person’s ability to do the job. He points out that GINA will require employers to format their policies to expressly indicate that they do not discriminate on the basis of genetic information, adding that it is best for businesses to avoid contact with employees’ genetic information altogether.
