Bloomberg spoke with Gardere Partner Peter S. Vogel, chair of the Firm's Internet, eCommerce and Technology Industry Team, about Google's fair-use defense against plaintiffs' copyright infringement claims. Plaintiffs argue that the company has taken away their rights for its own gain without compensating them by digitally copying millions of books for online searches.
"I'm not optimistic that Google is going to win on summary judgment," Mr. Vogel said. "This is going to go on for a while in order to figure out what the fair use is."
