Energy Choice Matters, a national trade publication for the competitive electricity industry, published an article quoting significant excerpts from an amicus filing of an industry coalition. Gardere Attorneys Catherine J. Webking and Andres S. Medrano served as lead counsel on behalf of the Firm's client TEAM, a trade organization of retail electric providers, and a coalition of other Texas retailers including NRG Retail and TXU Energy.
Ms. Webking and Mr. Medrano prepared and filed the amicus brief in response to an administrative order that made a number of incorrect conclusions regarding the responsibility of retailers to disclose third-party utility fees to their customers. If the order's conclusions were adopted by the Commission, the competitive market structure and recovery of regulated utility fees would be severely disrupted.
