The Foley IP Litigation team secured two notable inter partes review victories on behalf of client SDI Technologies, Inc. (SDI) today. SDI requested inter partes reviews of U.S. Patent Numbers 8,401,682 B2 (’682 patent) and 8,364,295 B2 (’295 patent), which Bose asserted covered iPod compatible speaker systems such as accused speakers in SDI’s line of iHome products.
On September 4, 2014, a trial was held before the U.S. Patent and Trademark office on both patents. Today, the Patent Trial and Appeal Board ruled that SDI proved that all of the challenged claims are unpatentable.
“Bose has continued to seek patent protection in an improper attempt to claim that it invented iPod compatible speakers with remote controls. This ruling confirms that these speakers were not an invention of Bose,” said Foley Partner Matthew Lowrie.
