Seasoned Health Care Litigator Frank Pasquesi Returns to Foley in Chicago
Foley announced today that Frank Pasquesi is returning to the firm’s Business Litigation & Dispute Resolution and Health Care Practices as a partner in the Chicago office.
Pasquesi brings deep experience and knowledge of the health care industry, having most recently served as senior vice president of litigation and assistant general counsel at CVS Health Corporation, the largest U.S. pharmacy health care provider and a Fortune 12 company with business operations in retail pharmacy, pharmacy benefit management, specialty pharmacy and retail clinics. During his tenure at CVS, he held enterprise-wide responsibility for litigation and oversaw a broad spectrum of legal areas and matters, including commercial litigation, government and internal investigations, employment litigation and intellectual property. He also provided legal support for mergers and acquisitions and risk management. Additionally, Pasquesi handled matters involving consumer fraud and consumer protection statutes, securities and shareholder derivate claims, the Health Insurance Portability and Accountability Act and privacy issues, Drug Enforcement Agency regulatory requirements and disputes arising from contractual relationships with clients, pharmaceutical manufacturers and vendors.

Prior to CVS, Pasquesi was a Foley partner and vice chair of the firm’s Litigation Department from 2006 through 2011. He previously represented CVS as a longtime advisor and handled many of its most significant litigation matters, including a number of landmark victories for the company on Employee Retirement Income Security Act (ERISA) issues and various significant class action lawsuits.

Upon his return to Foley, Pasquesi will resume his focus on handling complex litigation matters and strategically advising clients across an array of industries, including health care, pharmacy benefit management, pharmaceutical, financial services, retail and telecommunications. In addition, he will represent companies in the defense of high-profile state and federal litigation, including class actions, false claims and other whistleblower litigation as well as claims involving consumer fraud and other consumer-related issues, securities issues, ERISA, breach of contract, and alleged statutory violations (e.g., any willing provider statutes, Telephone Consumer Protection Act, etc.), among others. Pasquesi also will counsel clients on corporate compliance, internal reviews and investigations, government inquiries and white collar criminal matters.
