Law360 spoke with Gardere Partner Clifford J. Risman about hospitality cases to keep an eye on in 2015, including the ongoing breach-of-contract battle in New York between the owner of Miami's Eden Rock hotel and the hotel's operator Marriott International Inc. Mr. Risman, who chairs the Firm's Hospitality Industry Team, told Law360 that the recent Eden Roc decision has shaken up the principal agent designation that's long been a mainstay in hotel management agreements.
"This whole area of law that seemed fairly settled for a period of time has a bunch of nuances that have been rearing their head about whether management contracts are principal agent relationships, which really the case law has indicated for the last 20 years in most jurisdictions," Mr. Risman said.
