Partner Don Schroeder is quoted in a Law360 article, “Sportscaster Urges 1st Circ. To Nix Test Used in ADA Cases,” about renowned Boston sportscaster Bob Lobel’s appeal of a federal judge’s ruling in favor of a golf course Lobel had accused of discrimination for prohibiting him from driving on its putting greens in a specially-equipped golf cart.
The judge had granted the golf club’s motion for summary judgment in May, saying it met all the basic features of a private club and is therefore exempt from providing certain disability accommodations, such as expanded access for medically necessitated golf carts.
Schroeder, who represents the golf club, told the court there is no indication Lobel intends to use the course again since the friend and former club member who invited him to golf there left the club earlier this year.
“There is no reason to believe that Mr. Lobel would want to golf at Woodland [Golf Club of Auburndale] ever again,” he said.
