Dodson Quoted in Law360 About Recent Ruling on EEOC Wellness Regulations

Senior Counsel Marian Dodson was quoted in the Law360 article, “EEOC Wellness Incentive Wipeout Leaves Employers in Limbo,” about the uncertainty employers face in recruiting workers to participate in workplace wellness programs after a federal court nixed a key part of United States Equal Opportunity Commission regulations which spelled out guidelines for implementing those programs.
With the guidance on how to incentivize participation now gone, employers need to be careful about encouraging healthy habits among their workers. “Everybody’s in the same boat, nobody knows what to do,” Dodson said. But the stricken provisions can still serve as a guidepost, she added.
