Stoll Quoted on EPA Environmental Appeals Board Ruling to Better Justify Waste Permit Review Data

Partner Richard Stoll was quoted in an InsideEPA.com article on July 31, 2014 titled, “EPA Ruling May Pressure EPA to Better Justify Waste Permit Review Data.” The article examined a new ruling from the U.S. Environmental Protection Agency’s Environmental Appeals Board (EAB) that says EPA needs to better justify its decision to impose stricter pollution limits than federal rules require following a site-specific risk assessment of a waste combustion unit. Stoll, an attorney for the industry coalition Cement Kiln Recycling Coalition, an industry organization which is an amicus party in the case, told EAB that agency risk assessors crafted the limit using an unrealistic default value in agency guidance, and imposed a limit that “was not based on reality.”
