Katelynn Williams Quoted on Trump Administration Approach to Independent Contractor Rule

Writing in a Foley Labor & Employment Law Perspectives blog quoted in the article, Williams said the change in presidential parties means it is likely that the independent contractor rule finalized last year will see changes.

“We can expect that the DOL will drop its defense of the 2024 Independent Contractor Rule, which had rescinded the Trump 1.0-era test for independent contractor classification under the FLSA,” Williams explained, suggesting that the DOL may either restore the 2021 Independent Contractor Rule or leave it to the courts to judge classification issues.
