“各州有权监管其管辖范围内的雇佣行为,”富乐律师事务所反垄断与竞争业务部副主席德莱顿表示,“若我是医疗雇主,我会重点关注州级层面的行动。”
他建议医疗雇主除竞业禁止协议外,还可根据当地竞争格局和医疗专业领域部署其他工具,包括禁止招揽协议、保密协议以及固定期限合同。
德莱顿指出,美国联邦贸易委员会推行联邦法规的关键原因之一,是为整合各州现行法律的碎片化局面。他强调,随着医疗服务提供者和患者跨越州界流动,"如果法律权利在不同州之间发生根本性变化,这显然并非理想状态。"
“但反驳观点认为,一刀切的做法并不适用,各州在划定这些界限时都相当审慎,”德莱顿补充道。
