Alan H. Einhorn represents provider networks, hospitals, clinics, practice groups, and individuals in assessing and implementing physician/hospital integration and alignment strategies, in medical staff development and governance matters, and in compliance and operations matters. He also regularly advises clients on strategic, corporate compliance, tax exemption, and regulatory issues, and he advises hospital, network, and business clients on a wide variety of telemedicine and related issues, including strategic and legal considerations associated with the development, implementation and scaling of telemedicine service offerings. Alan is known for his ability to connect with colleagues, clients, and opponents and for accomplishing his and his clients’ goals with respect, credibility, persistence, and hard work. Alan is a member of the Firm’s Health Care Industry and Health Information Technology Teams. He is also co-chair of the Foley Health Care Industry Team’s Compliance and Operations Work Group; and he is Foley’s liaison to the Association of Corporate Counsel’s Health Law Network, for which Foley is Network Sponsor.

Alan has authored numerous articles on health care topics and has spoken at numerous health care conferences and seminars. As examples, in just the last several months, Alan has made web presentations for the Association of Corporate Counsel Health Law Network entitled “Compliance, Ethics & Governance: Understanding the Board’s and Manager’s Roles” and “Hospital at Home: An Emerging Approach to Care,” presented at the AMCCBS (Cancer Summit) on “Regulatory Considerations Post-PHE,” presented at a Massachusetts Hospital Association web conference on the EMTALA Implications of a newly promulgated Massachusetts EMS regulation relating to behavioral health services, and co-authored an updated chapter on EMTALA for the Massachusetts Continuing Legal Education publication entitled “Hospital Law Basics.”

Prior to joining Foley, Alan was a partner with an international law firm, where he established a strong practice in health care law.

Alan has served on several key committees in his home-town of Brookline, Massachusetts, which committees evaluated, and then assisted with the development of mixed use housing in the Town; and he also served on the design review committee that oversaw and assisted with the development and implementation of a 10 acre park in the Town on an abandoned reservoir site. A former captain of a ‘top 10 in the nation’ Division 1 college soccer team, Alan also served for 10 years as the president of the tax-exempt organization that operates the travel soccer program for the Town. During that time, Alan spear-headed successful efforts to raise several hundred thousand dollars, funds that were instrumental to the construction of two artificial surface soccer fields in the Town. Alan has also raised more than $1.25 million for the Pan-Massachusetts Challenge (“PMC”), a 2 day, 160+ mile bikeathon to support cancer research at the Dana Farber Cancer Institute in Boston. It is the most successful athletic fundraiser of its kind in the world, having raised more than $900 million for the Dana Farber since the PMC’s inception in 1980. Alan is counsel to the event and has ridden in the event for 38 years.

“Acute Hospital Care at Home”: Omnibus Bill Extends Flexibility Period to December 31, 2024
