Foley Partner Russell Beck authored an article titled “Commentary: Binding mediation: a nearly perfect imperfect solution” in the October 20, 2008 issue of Massachusetts Lawyers Weekly. In his article, Beck provides insight into the structuring of a binding mediation, an alternative to litigation and arbitration where the mediator between parties holds the right to issue a final decision if negotiations between the parties prove unsuccessful.
