FDA has released a proposed rule to govern "gluten-free" labeling on food products. Congress required FDA to begin rulemaking on the issue of "gluten-free" claims as part of the Food Allergen Labeling and Consumer Protection Act of 2004 ("FALCPA"). FALCPA directed FDA to issue its proposed rule by August 2006 with a final rule to be implemented no later than August 2008.
The proposed rule will be published in the Federal Register on January 23 and the comment period will be open for 90 days.
