In the March 13 issue of Competition Law360, Howard Fogt was quoted on the proposed class action changes by the European Commission, which give consumers the power to collectively seek damages from companies that provided them with flawed products or services. He states that the Commission’s class action initiative would help push the consumer welfare goals, but progress of these changes will be slow unless there is a fundamental change in the enforcement procedures.
