Foley Partner and co-chair of the Life Sciences Industry Team Judith Waltz was quoted in two articles in the November 2, 2009 issue of Medical Practice Compliance Alert. In an article titled “Expect more whistleblower claims, less clarity,” Waltz discusses the extended protection granted to consultants and outside contractors under the Fraud Enforcement and Recovery Act, noting that it is not clear how the remedies of retaliation protection would apply to individuals not employed by a company dealing with a whistleblower lawsuit. In an article titled “4 steps to protect the practice from the expanded FCA,” she states that companies should document the legitimate reasons for taking negative action against an employee, consultant or agent in order to avoid facing retaliation protection in a whistleblower lawsuit.
