Foley Partners Frederick Geilfuss and Lawrence Vernaglia were quoted in an article that appeared in BNA’s Health Care Fraud Report titled “Attorney Says ACOs Can Offer Protection From Stark, Antitrust Laws if Done Correctly.” They discuss accountable care organizations (ACOs), stating that providers who are careful about how they create an ACO should be protected from Stark, antitrust and anti-kickback laws when the Centers for Medicare & Medicaid Services releases its proposed regulations at the end of the year. The attorneys add that safeguards need to be established so providers can share savings within ACOs and so that the flow of money from ACOs to the participants does not result in anti-kickback violations.
