E-Commerce Times covered California citizens' attempt to begin a class action against Facebook for the company's use of "likes" and members' images for economic benefit. According to Gardere Partner Peter S. Vogel, chair of the Firm's Internet, eCommerce and Technology Industry Team, "Unjust enrichment is a tort, which says that a defendant got money unfairly to the plaintiff's disadvantage. One of the advantages to a tort is that you can sue for punitive damages as well."
