Stoll Quoted on Clean Water Rule Decision by Court of Appeals

Partner Richard Stoll was quoted in a Bloomberg BNA article, “Water Pollution: Views on 11th Circuit ‘Punt’ on Water Rule Mixed,” on August 17, 2016. The article discussed the U.S. Court of Appeals for the Eleventh Circuit decision to stay legal proceedings until the Sixth Circuit reviews the merits of the Clean Water Rule. Stoll said the Eleventh Circuit’s decision was driven by the need for the courts to exercise what it termed “prudential restraint.” He was quoted saying, “I can see how the 11th Circuit judges may have thought this makes sense for judicial economy. Like if the Sixth Circuit Ultimately vacates the rule – which seems likely in light of their earlier stay decision – you could say judicial economy is served under the theory that puts an end to the matter except for Supreme Court review.”
