Director of Public Affairs, Jennifer Walsh was quoted in a Law360 article, “5 Key Takeaways from Senate’s ACA Repeal Bill,” covering criticisms against the Affordable Care Act repeal bill from both conservatives and insurance industry experts.
Republicans plan to pass the repeal bill, also known the Better Care Reconciliation Act (BCRA), as budget reconciliation with a simple majority. However, the BCRA provisions must pass the Byrd rule, which prohibits ‘extraneous matters,’ including provisions with budgetary effects that are ‘merely incidental’ to the provision in question.’
Walsh notes that much of the BCRA content “historically would not have passed the Byrd rule.”
