Murray Comments on Dilemma Facing Defense Secretary

Partner Frank Murray was quoted in a BNN Bloomberg article, “Trump Attack on Cloud Bidding Gives Pentagon Chief Hard Choices,” about President Donald Trump’s criticism of a $10 billion Pentagon cloud-computing contract that Amazon or Microsoft are in line to win.

If Defense Secretary Mark Esper were to cancel the contract, Amazon or Microsoft could lodge a protest with the Government Accountability Office or file a lawsuit arguing that the cancellation was arbitrary and capricious and tainted by political interference, Murray said. But such arguments are “tough to show” in court, he added, especially if the Pentagon can establish a written record supporting the decision.
