Nathan A. Beaver and Ladonna Y. Lee will summarize the Food Safety Enhancement Act, passed by the U.S. House of Representatives in July 2009 and by the U.S. Senate in November 2010. Mr. Beaver and Ms. Lee will discuss the key differences between the two versions, how the chambers will resolve those differences, and the likelihood of passage during the upcoming lame duck session. Bernard J. Bobber will explain the elements of the trade secrets doctrine of inevitable disclosure and what the recent ruling in Bimbo Bakeries USA, Inc. v. Botticella, (3d Cir. 2010) means for food industry companies. Mr. Bobber also will discuss strategies to prevent unfair competition from former employees, and on the other hand, avoid liability when hiring from a competitor.
