Adam Hepworth, an Associate in Foley’s Health Care Practice Group, will be part of a panel at this year’s Connecting Michigan Legal Summit on Monday, June 3rd. The panel, titled “Yes, We Can Share Behavioral Health Data: Common Misconceptions and Barriers to Information Exchange,” will take place at 1:15pm, and Mr. Hepworth will be joined by Tara Adams Ragone (Assistant Professor, Center of Health & Pharmaceutical Law & Policy, Seton Hall University School of Law), Corey Waller (Principle Consultant, Health Management Associates), and Pamela Greenberg (President & CEO, Association of Behavioral Health and Wellness).
While the electronic sharing of physical health information is becoming common place, and greatly benefited care coordination efforts, the sharing of behavioral health information is severely lagging. Due to strict confidentiality regulations, such as 42 CFR Part 2, and ambiguous state mental health codes, healthcare practitioners are reluctant to send this information even with appropriate consent. Much of this hesitation is the result of uncertainty surrounding which information has special protections, when consent is required to share information, and what adequate consent must look like. This session will answer those questions and more as it discusses common misconceptions surrounding behavioral health regulations and poses solutions to promote greater sharing, while allowing patient privacy protections to remain intact.
