Foley Partner Monica Chmielewski and Of Counsel Don Romano will both be presenting this year’s Emerging Issues in Healthcare Law Virtual Conference, hosted by the American Bar Association, taking place March 8-12, 2021.
Monica Chmielewski will be presenting on Wednesday March 10th at 10:45 a.m. CT with fellow panelists Alexandra Phalen (Assistant Professor of Microbiology & Immunology, Georgetown University), Robert Schecter, MD (Chief, Immunizations Branch, California Department of Public Health), and moderator Allison Winnike (President/CEO, The Immunization Partnership). Their presentation, entitled “Mandatory COVID-19 Vaccines: Public Health, Personal Autonomy, and the Law” will provide an overview of the legal basis for vaccination requirements at the federal state, and/or local levels, including the basis/need to include exemptions. The panel will consider the possibility of a compulsory COVID-19 vaccination, including issues around enforcement, exemptions, and other critical concerns. Since we do not yet know where the country will be at with respect to COVID-19 in March, or where the vaccine development will be at that time, this will be an evolving presentation that will ultimately address the most pressing considerations related to COVID-19 vaccinations and related legal considerations.
Don Romano will be presenting on Friday March 12th at 11:15 a.m. CT with Jessica Bailey-Wheaton Vice President & Of Counsel, Health Capital Consultants. Their presentation, entitled, “Stark Law & Anti-Kickback Statute Final Rules: Valuation Implications,” will provide an analysis of legal & valuation perspectives on the changes made by the Final Rule (expected late 2020) to the Stark Law & Anti-Kickback Statute. The presenters will briefly review the most significant suggested changes yet focus on those rules that implicate healthcare valuation (e.g., changes to the Big 3 Requirements – Fair Market Value, Commercial Reasonableness, & the Volume or Value Standard), and the new exceptions/safe harbors for value-based arrangements. The session will conclude with a discussion of the potential impact of these changes, including how they may influence current fraud & abuse case law, the interplay between FMV & General Market Value, and healthcare valuation practice going forward.
