Foley Of Counsel Gregory Husisian authored an article that appeared in the July 2011 issue of Aftermarket Business titled “Third Parties and the FCPA.” Husisian discusses the Foreign Corrupt Policies Act (FCPA) problems raised by agents and distributors. He states that because agents and distributors are used so often by many companies in the automotive sector, no compliance program can function unless it successfully deals with these intermediaries. Husisian adds that the implementation of an effective FCPA compliance program is one of the best means for companies with frequent exports and operations abroad to minimize the risk of FCPA prosecution.
