Gardere Labor and Employment Partner Carrie Hoffman spoke to Androvett Legal Media & Marketing about the increase in lawsuits alleging failure to pay overtime under the Fair Labor Standards Act.
"Employers should not provide smart phones or remote access to non-exempt employees unless they have policies in place to ensure those employees are being paid for all hours worked," says Ms. Hoffman. "The FLSA has remained mostly unchanged since its enactment in 1938. Previously, when you punched out of work, you were done with work for the day. It's easier now to blur the lines, but employers who fail to adhere to the strict rules of payment for all hours worked will likely find themselves facing expensive litigation."
