Gardere Represents Catlin Insurance in Kohl's Construction Coverage Dispute
Law360 covered the Texas appeals court ruling that upheld Gardere client Catlin Specialty Insurance Co.'s win over Williams Development & Construction Inc. and a subcontractor. The matter was in regard to a dispute over coverage for an underlying suit concerning construction defects at a Kohl's store. In a unanimous decision, a three-judge appellate panel affirmed the trial court's take-nothing judgment against Williams and the subcontractor, Adolfo Vela, ruling that Catlin had no duty to defend or indemnify the subcontractor.
Gardere Partner Alexander C. Chae, who represented Catlin with assistance from Associate Elliot Strader, told the publication that "we are obviously very pleased with the appeals court's affirmation of the judgment in the insurer's favor. The court's opinion, which was a very well-reasoned and careful analysis of the law and facts, hopefully puts an end to a long seven-year journey for our client."
