New edition to help multinational companies operating in China comply with U.S. anti-bribery law
SAN FRANCISCO – Multinational companies with operations in China now have access to the first of its kind anti-corruption compliance book available in Chinese to educate their Chinese workforce and business partners. Authored by Foley & Lardner LLP Partner Aaron Murphy, translated and adapted to Chinese by FTI Consulting Senior Managing Director Jean Chow-Callam, Foreign Corrupt Practices Act: A Practical Resource for Managers and Executives (“给中国企管的反腐合规指引”) provides an in-depth discussion of real-world corruption risks and how compliance programs can be structured to address them, which is a topic of concern to any multinational business with operations in China.
The timing of this translation aligns with increased domestic anti-corruption enforcement by the Chinese government. For multinational corporations and domestic Chinese companies alike, the FCPA provides a strong foundation for the development and enforcement of compliance programs as it is often considered the basis for international anti-corruption laws across the world.
“As Chinese companies continue to expand and access foreign markets, they will be subject to legal, regulatory, financial disclosure and transparency obligations that will require them to run their businesses in ways that may seem foreign to them,” said Foley & Lardner LLP Partner and Author Aaron Murphy, who is a member of the firm’s Government Enforcement, Compliance & White Collar Defense Practice Group. “This book will be a crucial resource for any company looking to educate and train its Chinese employees and business partners in their native language, and help Chinese businesses expanding outside China familiarize themselves with international compliance expectations.”
Highlights from the book include:
- Key components of a compliance program that is effective, simple, easy to administer, and does not have to be drastically changed every time the company enters a new market
- A snapshot of the current anti-corruption landscape and requirements of the world’s top 20 economies
- Critical key compliance takeaways such as which countries hold corporations criminally responsible for corruption, what constitutes corruption and issues surrounding facilitation payments
The book was originally published by John Wiley & Sons and is now available from one of China’s largest publishers, China Machine Press.
